In Ontario, intended parents using a surrogate can be listed as parents on a child’s birth certificate without needing to adopt a child so long as they have a Surrogacy Agreement in place prior to conception. A Surrogacy Agreement also defines the rights and obligations of the intended parents and the surrogate throughout their relationship. Sperm Donor Agreements
